1.0 Contract
1.1 The below Terms & Conditions are a legal binding agreement between you as the client and DNF as the company. This is for Date Night Fairies Limited.
1.2 Completion of the following – completion of the BOOK NOW form, placing a booking via our app, payment of the service fee or accepting in writing via email or verbally via telephone conversation is instant acceptance of the companies Terms & Conditions.
1.3 The word “DNF” refers to Date Night Fairies.
1.4 The word “Client” refers to the person/family using DNF services.
1.5 The word "Babysitter" or "Fairy" refers to a Date Night Fairies employee/contractor.
1.6 The Terms & Conditions are the terms of which DNF offers the client access to the services and use of the DNF website, app and company. If the client does not agree to abide by these Terms & Conditions, then the client must refrain from using the DNF website and app.
1.7 Posting false, incomplete, inaccurate or illegal information is strictly prohibited and may be punishable by law.
1.8 Unlawful or illegal use will be reported to the proper authorities and may be punishable by law.

2.0 Client Obligations
2.1 Any correspondence, communication either verbally, written or via email is confidential and the client agrees not to disclose to third parties.
2.2 All bookings must be made directly between you and DNF.
2.3 No bookings are to be made directly with the Fairy. Should this obligation be ignored the Fairy is legally obliged to inform the company and the relevant fees will be charged to the client.
2.4 The client agrees there is a minimum 3 hour booking payable to DNF for Date Night Fairies services, with Housekeeping Fairy bookings being set in pricing with set hours.
2.5 The client agrees to pay DNF with the fees being outline in the invoice that will be emailed to the client when the booking has ended, with 'overtime' fees being charged at $7.50 per 15 minutes late, with the amount being rounded up to the nearest quarter hour. The client agrees to pay the full invoiced amount within 48 hours of the invoice being sent by DNF.
2.6 The client is required to pay DNF in full when submitting a booking via our app. The payment will only be accepted when a Fairy has accepted the booking request. If no Fairy is able to accept the booking request, DNF will immediately release the funds back onto the clients credit card.
2.7 The client agrees that DNF requires our Fairies to be in an occupationally safe environment.
2.8 Where DNF (in its absolute discretion) believes that there is sufficient negative feedback or feedback is of a concerning nature regarding the client, then DNF will refrain from providing any Fairies towards bookings.
2.9 The client agrees to pay travel fees where required that is mutually agreed upon via email which will be discussed and agreed upon during the booking confirmation.

3.0 Client Fees
3.1 Fees are payable in New Zealand Dollars.
3.2 All service/booking fees are non-refundable, including if the client cancels booking.
3.3 All service/booking fees are payable per booking.
3.4 If the client has paid a booking fee and decides to change booking date, the 15% service fee can be transferred to another date if DNF are able to find a fairy who can cover the booking time. If no fairies are available on the new booking date, the original date must hold the right of the service/booking fee. It is up to the client to cancel the booking or continue with original date. If the client cancels, the service/booking fee is non-refundable.
3.4 DNF holds the right not to send a Fairy out to a families booking if the service/booking fee has not been received via internet banking and in the companies bank account within 24 hours of commencement date (this clause is only applicable to website bookings).
3.5 The invoice will be sent via email with payment due within 48 hours or otherwise stated.
3.6 If the payment is not received within 48 hours of the invoice being due, a penalty fee of $10 per day will apply and is payable to DNF account with the remainder of the invoice fees.
3.7 DNF reserves the right to change and amend fees at any time.
3.8 Public holidays incur a surcharge of $15.00 per hour, with each three hour package equaling a $45.00 surcharge minimum.

4.0 Cancellation Policy 
4.1 If cancellation of the babysitter is made within 3 hours of start time, a minimum of 3 hours will be charged to the client.
4.2 If the cancellation of the babysitter is made within 24 hours of start time, a minimum of 1 hour will be charged to the client.
4.3 If the cancellation of the Fairy is made more than 24 hours of the start time, there will be no cancellation fee however the booking/service fee of 15% is non-refundable and will be charged to the client.
4.4 If the allocated Fairy is unable to attend the booking, DNF reserves the right to select another Fairy to complete the booking.
4.5 If the allocated Fairy is late to the booking, the client will not be charged for the duration of the absent Fairy.
4.6 If the allocated Fairy does not arrive for the booking, the client will receive the booking payment refunded in full, plus one free hour (valued at $30) to go towards their next Fairy booking (the free hour is not redeemable for cash and is non-transferrable).

5.0 Refunds
5.1 Although DNF aims to find a Fairy to complete all booking requests, we cannot always guarantee this will be possible.
5.2  In the unfortunate circumstance where a Fairy cannot be found on the requested date, the full payment will be refunded.
5.3 This full refund also applies if the booked Fairy cancels or no-shows to the booking and a second Fairy cannot be found in a timely manner.
5.4 No refunds will be given if the client is unsatisfied with DNF service and Fairies, however DNF will work hard to rectify any issues the client may have.

6.0 Liability
6.1 DNF accepts no liability or responsibility for accident, injury, loss, damage or misconduct sustained by a Fairy, clients or any other persons and by booking a Fairy through DNF, the client agrees to exclude DNF should any mishap occur.
6.3 DNF aims to validate the background of our Fairies with accuracy. DNF conducts thorough checks, conducts interviews, and ensures the Fairies have clean NZ police records with current first aid certificates.
6.4 DNF holds a $5,000,000 Public Liability Insurance policy that covers all Fairies for the duration of their bookings that are placed via DNF.

7.0 Confidentiality
7.1 All communication between both parties (DNF & Clients) shall remain confidential.
7.3 DNF requires the client to provide accurate details of their address, contact details and full name.
7.4 DNF will release personal information only when the above release is appropriate for the function of the website, to comply with the law; enforcement of our terms and conditions; or protect the rights, property, or safety of DNF, or others. However you authorise your Fairy to tell a family member or friend where she/he will be, the expected return time and address of the Fairy booking. This is a simple safety measure for the Fairy.

8.0 Privacy 
8.1 DNF does not sell or rent the client’s personal information or identification to third parties.
8.2 DNF does not employ other companies to maintain, make changes or access in personal or client information. 
8.3 As DNF is a growing business, there may be a change in ownership or management from Support Office to different regions. When a change occurs, client information will be one of the transferred assets.
8.4 DNF will release information to third parties when we believe this is appropriate to comply with the law, police or fraud investigations, to protect the rights of DNF, our IP, our users or others.

9.0 Warrantees and Indemnities 
9.1 No warranty is given for capability and character of any Fairy. 
9.2 We make no warranties or representations as to the quality, accuracy or completeness of the content on the site or the information otherwise provided by any member.
9.3 The Client will hold DNF harmless against any claims arising out of any claims brought against it arising from the client’s dealings with and treatment of the Fairy howsoever arising.
9.4 While DNF uses reasonable measures to ensure that the site is available 24 hours a day, DNF does not make any representations or warranties that your access will be uninterrupted or error free. Access to the site may be suspended temporarily without notice in the case of system failure, web hosting errors, maintenance or repair or any reason beyond our control.

10.0 Disputes
10.1 DNF prefers to resolve any disputes via mediation. 

11.0 Copyright and Trademarks
11.1  All content on DNF website – texts, graphics, images, HMTL codes and other material (collectively the “Material”) are protected by New Zealand and international copyright laws and remain the exclusive property of the Date Night Fairies Limited company.

12.0 Governing Law
12.1 The Terms & Conditions shall be governed in accordance with the laws of the state of New Zealand and users hereby submit to the non-exclusive jurisdiction of the Courts of that state.
12.2 DNF website, IP, copyright is owned and registered by Date Night Fairies Limited, with the registered Director being Sharnika Leopold.


Date Night Fairies Limited reserves the right to change our Terms & Conditions at any stage.
